Binghamton Car Accident Attorney Urges New York Motorists to Use Caution with Holiday Travel

With AAA predicting around 84 million Americans to hit the road this holiday, the law firm of Scott C. Gottlieb, Injury Law Attorney, says steps need to be taken to avoid auto accidents.

New York motorists should exercise extra caution on the roads now that winter is officially underway and, according to a recent USA Today report, millions of drivers will be on the roads for the holidays, Binghamton car accident attorney Scott C. Gottlieb said today.

“Millions of families will be traveling to see loved ones over the holidays,” said Gottlieb, whose Binghamton personal injury firm, Scott C. Around 84 million people are expected to hit the roads for the holidays this year, according to a USA Today report that cited forecasts from the AAA travel organization.

“Drivers who are caught up in the rush to get last-minute presents or to attend holiday events are more likely to get distracted behind the wheel, which can be deadly in winter weather,” said Gottlieb. “Icy and snowy road conditions demand extra attention, not the opposite.”

Alcohol is a big contributing factor in holiday accidents, Gottlieb added. Last year, 415 people died in alcohol-related crashes during the second half of December alone, according to the National Highway Transportation Administration.

“The flood of holiday parties and time off work means that people have more time to socialize, and that can include drinking,” Gottlieb said. “Designating a driver is a simple way to prevent catastrophic accidents at any time of year, and it is especially critical in freezing and slippery conditions.”

The Binghamton personal injury attorney added that even the most experienced driver is vulnerable to harm while driving in winter weather.

BOSTON , Dec. 15, 2011 /PRNewswire/ -- Youth sports should provide a fun, social and character-building experience, but too often the public focus is put on negative events and poor sportsmanship.  As a result, earlier this year Liberty Mutual Insurance and Positive Coaching Alliance embarked on a search for demonstrations of sportsmanship, sacrifice and selflessness at the youth sports and amateur sports levels in an effort to identify the "Top 10 Responsible Sports Moments" of 2011.  Today, after receiving almost 100 nominations on Facebook that spotlight and celebrate the positive impact and power of youth sports, Liberty Mutual and PCA are honoring these moments and the young people behind them.

St. Mary's of Lynn (Mass.) ends 100 win streak but congratulates Hingham HS - After St. Mary's of Lynn lost in the Massachusetts Division 1 girls ice hockey quarterfinals to Hingham High School, ending a 100-game winning streak that spanned four seasons, senior captain Sabrina Iannetti boarded her opponents' bus, congratulated the team who ended her high school career two games short of perfection, and promised that St. Mary's would cheer them on through the rest of the state tournament.Andover (Minn.) HS runner carries Lakeville South opponent to finish race - Running in a recent cross country meet for Andover High , Josh Ripley , a junior varsity runner was making his way through the trail at the Applejack Invite when he heard a loud scream during the first mile of the two-mile race.  Most of the other kids running didn't pay much attention to Lakeville South runner Mark Paulauskas , who was writhing in pain at the time, as they passed by but Ripley stopped and carried the injured runner a half mile back to coaches and family members. Oyster River (N.H.) HS special needs student/manager given her moment in the spotlight - Kate Messler , an Oyster River High School ( Durham, N.H. ) senior and player/manager for the varsity girls basketball team, cheered for her team each game but never got a chance to play.  Until this year, when for the first time, Kate, a special needs student with a developmental disorder, was called into a game to start the second half.  She sank two three-point shots, including one at the buzzer! Episcopal Academy (Pa.) rowers stop to help capsized opponents during race - James Konopka and Nick Mead of Episcopal Academy in Newtown Square, Pa. were cruising along in the Under-17 doubles race when they passed a capsized St. Joseph 's Prep boat.  They both agreed they should go back and help those in the other boat who were yelling 'help' even though they were competitors. They stayed with the Prep boys until a launch arrived.  Hopelessly behind, the Episcopal rowers nevertheless completed the race. Tabor Academy (Mass.) student athlete gives back to community on top of athlete prowess - Torin Zonfrelli , a two-sport captain at Tabor Academy in Marion, Mass. , started a full-fledged charity and has led a number of urgent need drives to help those who are considered "less privileged."  Zonfrelli started The Zonfrelli Project, dedicated to donating food to families and individuals in need.  Eventually, the 17-year-old had enough support to supply the church food pantry at St. Anthony's church in New Bedford, Mass. , every Thursday. Suffield Academy (Conn.) donates uniforms and equipment to tornado-devastated lacrosse team - Springfield (Mass.) Cathedral High's lacrosse team had nearly all of its facilities and equipment demolished by the EF-3 tornado that tore through the state on June 1 .  That storm hit at a particularly uncooperative time, with the program nearing what was widely considered the most significant game in program history:  a playoff matchup against West Springfield (Mass.) High, one of Cathedral's conference rivals.  Another area rival -- Suffield Academy in Connecticut -- donated its entire stock of uniforms, helmets and gloves to help Cathedral get on the field. Fennville (Mich.) Players Rally for Lost Teammate's Family – Following the death of Wes Leonard , star player on Fennville High School basketball team who collapsed after a game-winning shot, different members of the team slept at the Leonard house each night, helping keep the family company while they adjusted to life without their oldest son.  Leonard's family said they plan to be involved in future prevention efforts geared at helping other teenagers scan for and avoid the heart defects which eventually led to their son's death. Ohio U-11 AYSO soccer coach encourages team to play through referee blunder with responsibility and grace - During a competitive U11 AYSO travel soccer match in Avon, Ohio , a coach displayed true sportsmanship to his team.  Facing a strong opponent, his team was winning by a goal late in the game.  The referee made a call in his team's favor, yet mistakenly awarded the direction of the free kick to the other team.  His players still confused by the call, an opposing player shot and scored into an unguarded net.  The teenaged referee realized his mistake and crouched down with his head in his hands. The coach walked onto the field, placed his hand on the referee's shoulder and spoke to him.  He then said aloud to his team, "it is a goal boys, no worries, now let's play soccer."  His team rallied and ended up winning the match. 8-year-old catcher in Maryland helps scared batter take his first swing 8-year-old Trevor Yusko , a catcher for a minor league youth baseball team in Frederick, Md. , was catching when a player on the other team was scared to death to step into the batter's box.  Trevor called time out, went over to the boy and gave him a pep talk. The young man then stepped into the batter's box, swung at the next pitch and fouled it off – a small achievement, but a big step in his growing confidence to play our national pastime. Plouffe Academy (Mass.) volleyball player joins opposing team to ensure all can compete – Heading into the State Tournament weekend, the Plouffe Academy Unified Volleyball of Brockton, Mass. , was carrying 13 eligible players, one more than the roster limit, meaning one would need to be chosen to be left behind.  Learning this, Plouffe player Cesar Romero selflessly volunteered to leave his team and join their sister team, West Middle School. When Cesar joined the team he once competed against, he soon made many new friends and served as a link between the two teams throughout the tournament weekend.  While the Plouffe team was eliminated from the tournament, Cesar served as a key player helping West achieve its gold medal.  Both teams were thrilled, West for winning and Plouffe for Cesar's sportsmanship and success.

'Barefoot Bandit' to plead guilty

SEATTLE, USA (AP) — Kyle Ater remembers the three-letter chalk message left on the floor of his Orcas Island grocery store after it was burglarised for the second time by the Barefoot Bandit. Next to cartoonish drawings of footprints was written, "C-YA!"

Nearly two years later, that prophesy is coming true. Ater said he'd be there in Island County Superior Court on Friday when Colton Harris-Moore, now 20, is expected to plead guilty to dozens of felony charges stemming from a crime spree that took him — in stolen boats, cars and planes — all the way to the Bahamas.

Harris-Moore's daring run from the law earned him international notoriety, not to mention a movie deal to help repay his victims, after he flew a stolen plane from Indiana to the Bahamas in July 2010, crash-landed it near a mangrove swamp and was arrested by Bahamian authorities in a hail of bullets.

"I want to see the phantom with my own eyes," Ater said. "There were so many people affected by his crimes, and probably even some that don't know they were affected. They're still looking for their cellphone, or wondering why their propane bill was so high that month."

Friday's proceedings before Judge Vickie Churchill consolidate cases against Harris-Moore in three Washington counties. He has already pleaded guilty to federal charges in Seattle and will be sentenced for those crimes early next year. He will serve his state and federal sentences at the same time.

State prosecutors plan to ask for a nine-and-a-half year sentence Friday, while Harris-Moore's attorneys, John Henry Browne and Emma Scanlan, are seeking a six-year term, citing his bleak childhood in a Camano Island trailer with an alcoholic mother and a series of her convict boyfriends. They laid out the details of his upbringing in psychiatric and mitigation reports filed with the court.

"Colt blames no one but himself," wrote Pamela L Rogers, a mitigation investigator who reviewed Harris-Moore's case. "He made bad choices and takes full responsibility and expects to be held accountable for those bad choices. ... He desperately hopes to one day have a career and a family and make contributions he can feel good about — and he's willing to work hard for that."

Harris-Moore's first conviction came at age 12, in 2004, for possession of stolen property, and according to Rogers' report, his first experience with burglary came when he broke into the homes of his classmates to steal food because his mother spent most of her Social Security income on beer and cigarettes — something she has denied.

Over the next three years he was convicted of theft, burglary, malicious mischief and assault, among other crimes. At one point he was arrested when a detective posed as a pizza-delivery driver.

In 2007, the boy was sentenced to three years in a juvenile lockup after pleading guilty to three burglary counts in Island County. But he fled the minimum-security facility in April 2008 and was soon back to his old tricks, breaking into unoccupied vacation homes, stealing food and sometimes staying there.

As red-faced investigators repeatedly failed to catch him, his antics escalated: He began stealing planes from small, rural airports and crash-landing them — at least five in all.

"What was characterised by the media as the swashbuckling adventures of a rakish teenager were in fact the actions of a depressed, possibly suicidal young man with waxing and waning post-traumatic stress disorder (following his first plane crash in November 2008)," wrote Dr. Richard S Adler, a psychiatrist who evaluated him for the defense lawyers.

Waves of burglaries broke out on Orcas Island, where Ater runs his Homegrown Market and Deli, in late 2009 and in early 2010, after stolen planes were found at the airport there. The second time, Harris-Moore left Ater's new security system in a utility sink, under a running faucet. He took cash and a tray of croissants, and Ater's insurance company jacked up his rates.

Mike Parnell, a former owner of the Oakley sunglasses company who lives on Orcas, was repeatedly victimized. Harris-Moore hid out for long periods in the second level of his hangar at the airport, and when Parnell and his family would go on trips in their plane, Harris-Moore would take their car to their house and eat their food. At one point, Harris-Moore entered their home while Parnell was there with his wife and three children and grabbed his wife's car keys off a counter.

"We were all fearing for our lives," Parnell said Thursday. "The kids wouldn't sleep in their own bedrooms. We purchased night vision goggles. I'm glad that day is finally approaching when we will finally know what the consequences are, and I hope it's sufficient for the way our whole island suffered."

Harris-Moore's final spree came after he stole a pistol in eastern British Columbia and took a plane from a hangar in Idaho, where investigators found bare footprints on the floor and wall. That plane crashed near Granite Falls, Washington, after it ran out of fuel.

He made his way to Oregon in a 32-foot boat stolen in southwestern Washington — stopping first to leave $100 at an animal shelter in Raymond. From Oregon, authorities said, Harris-Moore traveled across the United States, frequently stealing cars from the parking lots of small airports. In Indiana, he stole another plane and made for the Bahamas, more than 1,000 miles away, where authorities finally caught him in a manhunt that spanned multiple islands.

Fox bought the movie rights in a deal that could be worth $1.3 million, and Dustin Lance Black, who won an Academy Award for writing the movie "Milk," about the gay rights activist Harvey Milk, is working on the screenplay. He's met with Harris-Moore several times at the Federal Detention Center in SeaTac, according to Lance Rosen, Harris-Moore's entertainment lawyer.

Harris-Moore doesn't get to keep any of the money under the terms of his federal plea deal.

On November 30, 2011, USA Technologies, Inc. appointed Stephen P. Herbert as the Chairman of the Board of Directors and Chief Executive Officer of the company.  Herbert had held the posts on an interim basis since October 5, 2011.

Herbert's employee agreement provides for an initial term continuing through January 1, 2013, which is automatically renewed for consecutive one year periods unless terminated by either Mr. Herbert or the Company upon at least ninety days notice prior to the end of the initial term or any one year extension thereof.

Herbert's base salary is $341,227, plus the amount of the annual premiums that had been paid by the company for the car allowance and supplemental disability insurance coverage under his prior employment agreement; (ii) the car allowance and supplemental disability insurance coverage that had been provided to him under his prior employment agreement have been discontinued; and (iii) he is eligible for a cash bonus of $30,000 if the company would achieve all of the minimum threshold performance target goals under the Fiscal Year 2012 Performance Share Plan adopted by the Board of Directors of the Company on September 15, 2011, of $50,000 if the company would achieve all of the target performance goals under the 2012 Plan, and of $75,000 if the company would achieve all of the maximum distinguished performance target goals under the 2012 Plan.

Herbert has been an officer and a member of the Board of Directors of the Company since 1996, and has served as President and Chief Operating Officer of the Company since 1999.

The U.S. car rental industry’s $22.4 billion in revenues for 2011 is an industry record. Here’s a closer look at the numbers.

Porsche successfully places another ABS bond in the USA

Porsche AGFor the second time this year, Dr. Ing. h.c. F. Porsche AG, Stuttgart, has successfully issued an ABS bond in the USA. The transaction, worth approximately 660 million US dollars, was issued as a private placement by the subsidiary Porsche Financial Services Inc. headquartered in Lisle, Illinois, USA, and given top marks by the rating agencies. In the process, Porsche achieved one of the lowest credit margins for comparable transactions. On average, the coupon was just over one per cent. The investors were investment managers, insurance companies, pension funds, banks and corporations.

Despite the ongoing uncertainty and turbulence on the capital markets, Porsche was therefore able to demonstrate for the second time this year that there is still very strong investor appetite for top-rated bonds. “With both these transactions, Porsche has established itself as the benchmark for ABS bonds. Companies often require a number of years and several transactions to win the investors’ trust and achieve this success. Porsche has managed this with its very first two private placements,” said Lutz Meschke, Porsche AG’s Chief Financial Officer. “The strong investor demand again resulted in the bond being significantly oversubscribed, notwithstanding other major car manufacturer transactions being in the market at the same time,” Meschke added.

Encouraged by this response, Porsche aims to achieve a more regular presence in the US private bond market. The transaction was supported by J.P. Morgan, Barclays Capital and RBS as book runners and Societe Generale as co-manager.

Chiropractor raising funds for mom who needs kidney transplant

LEHI -- A little more than two months ago Crystal Hadlock spent most of her time playing with her two little girls, but now her time is spent hooked up to a dialysis machine that is keeping her alive. Hadlock was born with only one kidney but was living a normal healthy life until she was in a car accident and doctors discovered a problem with her only kidney. Hadlock was recently diagnosed with a renal artery aneurysm, meaning the vein running from her heart to her kidney was damaged.

"We found a surgeon that could do the surgery because they have to take the kidney out and re-implant it," Hadlock said. "But for some reason my kidney clotted off and I lost it."

She says another surgery was unsuccessful in trying to repair the damaged kidney, and the 27-yead-old now is living without kidneys. Hadlock had no insurance before the surgery and while she qualifies for Medicaid, out of pocket expenses still add up. But Chiropractic USA in Pleasant Grove is working to help Hadlock and her family.

"Crystal has been a patient here for the past year and her surgery didn't seem like it should be a big deal and then the world crashed down around her," said Chris Moore, a chiropractor at Chiropractic USA. "Every year we do a charity fundraiser in the office and we thought, 'Why not for Crystal?'"

The chiropractors are donating their services in exchange for donations for Hadlock. New patients can get a complete spinal check-up and adjustment for just $20. Moore says those services can normally cost more than $200.

"This is probably the best deal we have ever had," Moore said. "We are happy to be able to donate our services in exchange for a donation if it helps." Crystal "is a great person and a great mom and anything we can do to help her out we are more than happy to do."

Hadlock does dialysis three times a week for three to four hours at a time and is on a very restrictive diet that cuts out all salt and potassium and limits fluid intake.

She has been on the wait list for a kidney transplant since the beginning of December but says because she is a young and otherwise healthy person it could be six months to a year before she gets the kidney she needs.

"It is really hard," Hadlock said. Dialysis "is like having a part-time job and I feel sick most of the time. It is not very fun."

Moore says in addition to monetary donations he has had several people offer to be a kidney donor for Hadlock, even if they aren't a perfect match. He also says although $20 is the minimum for the services many patients have donated more.

"I think it is amazing. It means a lot to me that people are willing to do what they are," Hadlock said. "I am really grateful for a lot of help that has been given to us. When Dr. Moore told me what they were doing it just made me feel like there is hope."

The promotion at Chiropractic USA will run at least through the end of December.

About IIHS

The Institute's frontal crashworthiness evaluations are based on results of 40 mph frontal offset crash tests. Each vehicle's overall evaluation is based on measurements of intrusion into the occupant compartment, injury measures recorded on a 50th percentile male Hybrid III dummy in the driver seat, and analysis of slow-motion film to assess how well the restraint system controlled dummy movement during the test.

Side evaluations are based on performance in a crash test in which the side of a vehicle is struck by a barrier moving at 31 mph. The barrier represents the front end of a pickup or SUV. Ratings reflect injury measures recorded on 2-instrumented SID-IIs dummies representing a small (5th percentile) woman, assessment of head protection countermeasures, and the vehicle's structural performance during the impact.

Rear crash protection is rated according to a two-step procedure. Starting points for the ratings are measurements of head restraint geometry -- the height of a restraint and its horizontal distance behind the back of the head of an average size man. Seat/head restraints with good or acceptable geometry are tested dynamically using a dummy that measures forces on the neck. This test simulates a collision in which a stationary vehicle is struck in the rear at 20 mph. Seats without good or acceptable geometry are rated poor overall because they can't be positioned to protect many people.

In the roof strength test, a metal plate is pushed against 1 side of a roof at a constant speed. To earn a good rating for rollover protection, the roof must withstand a force of 4 times the vehicle's weight before reaching 5 inches of crush. This is called a strength-to-weight ratio. For an acceptable rating, the minimum required strength-to-weight ratio is 3.25. A marginal rating value is 2.5. Anything lower than that is rated poor.

Give the Gift of an Extra 10 Miles Per Gallon

Rather than giving an energy-guzzling device this holiday season, here are three ways to stuff a stocking with the gift of fuel efficiency

Gasoline-wise, 2011 has been a very expensive year. Who knows what gas prices 2012 will bring? Rather than giving lovely gadgets that will only consume more energy, like everyone else, here are three ways to stuff the gift of *less gas* this holiday season.

1. Turn Your Honda Civic Hatchback into a Homemade Hybrid for just $1600.

Green gearhead Nick Rothman is an electric car renaissance guy: Fluent in Japanese, he's a certified Prius mechanic, and has built scads of plug-in hybrids at Pat's Garage in San Francisco while developing a second career in custom electric bikes. A few years ago, he started tinkering on a salvage title Honda Civic hatchback, adding an electric motor in the spot where the air conditioner goes to boost starts. He wired it all together with a bunch of off-the-shelf batteries and controllers for around $1600. Driving around San Francisco, Nick toggled his electric motor throttle and engine kill button to boost the Civic's fuel efficiency by 42 percent, which works out to an extra 10 mpg. Now he's produced a how-to book about the process which you can buy from Electric Motor Sport and soon from Amazon, where he already sells a book on electrifying your bike.

Homemade Plug In Hybrid ($40, perhaps less as a Kindle edition) is a fine gift for eco-dreamers and tinkerers. It's full of illustrations and explanations and offers interesting strategies like building a mock version of the motor from cardboard to be sure it will fit inside the hood. Practically, however, you do need to know how to fabricate a drive sprocket and a lot more to make the car. But even if you have no intention of building your own hybrid, it's an education in the state of the U.S. electrical vehicle movement. First, you learn it's possible to build your hybrid with American-made parts. Nick prints detailed comparisons of components, listing those that are made in the U.S. and those that are not. For many in the electric vehicle business, DIY also means DI-USA, and tinkerers are often willing to take on heavier components because they're part of a "Little Magneto on the Prairie" vision.

"A lot of the best electric conversion components are made in the USA," Nick says. "The concept of converting cars to electric in your garage is still a very American phenomenon. It's an American tradition to take your car and lavish time and money on it to create something that didn't exist before. The Civic has become the modern Mustang -- there are endless catalogs of after-market parts.

Out of this grand-old tradition of building hot rods comes a new tradition, and new industry, of building cool rods.
(Next year, you may want to just give your loved ones all of your old coffee grounds. Here's a British car powered by gasified coffee grounds that averaged 66 mph in September.)

Option 2: Have a Hypermiling Holiday

While I was talking to Nick he mentioned that he'd been experimenting with ecodriving -- a way of driving to increase gas mileage -- and found he could sometimes get an extra 8 to 10 mpg out of his Honda Fit. The key, he says, is to invest in a feedback gadget, like this Scangauge, ($95 and up) which plugs into your car's computer system to tell you how much mileage you're getting out of every gallon and every tank. Then read up on the tricks of the hypermilers. Hypermiler Wayne Gerdes says he got 67 mpg from a 2009 Toyota Corolla XRS that the EPA has rated at 25 mpg. Some hypermiling moves are easy -- turning off the car when you're idling. Others -- like dramatically changing the rhythm of your driving patterns in traffic -- may require a personality transplant. Nick says he's found that almost everyone changes they way they drive when they adjust the Scanguage's feedback to show how much they're spending on gas every day. (If you add that daily cost of gasoline to the daily cost of insurance and the daily cost of auto financing, you may just want to try option three, below.)

Option 3: Where possible, get a bicycle, a pair of shoes, or a bus pass, and wrap it up in a very large box labeled "new car."
